1. GENERAL INFORMATION

These General Terms and Conditions regulate the mutual relations between the travel agency TUK TUK Makarska d.o.o., Požare 14a, 21300 Makarska, Croatia, OIB: 16414655368 as the tour organizer and authorized intermediary (hereinafter referred to as the Agency) and the traveler or the person contracting the trip or excursion (hereinafter referred to as the Traveler). By accepting these General Terms and Conditions, the Traveler confirms that he has read, understood and will comply with the General Terms and Conditions of the Agency. The General Terms and Conditions are an integral part of the travel program, excursion and mediation in the sale of excursions and travel, as well as the Travel Organization Agreement, unless the contracting parties agree otherwise.

2. MAIN FEATURES OF THE SERVICES

The content, program, prices of trips and excursions, as well as the minimum number of people required to complete the tourist program, are published and available on the Agency’s website www.etuktoursmakarska.com and include the contents listed in the description. The Traveler may request certain special and additional services (transfers, additional meals, optional excursions, fees, tickets, travel insurance, etc.) that are not included in the published program and content, and the Agency, if it has that option, may arrange them and include them in the excursion program or Travel Agreement. The Traveler will be informed about the price of special and additional services before booking the excursion or concluding the Travel Agreement and payment.

3. REGISTRATION OF RESERVATION

The Traveler can register for a trip or excursion via email, the reservation system on the Agency’s website or by phone. When making a reservation in any form, the Traveler voluntarily writes down the requested information displayed on the reservation system, or requested via email or phone call. The Traveler guarantees that he has provided the Agency with correct and valid information necessary for the smooth implementation of the excursion or trip and accepts all legal obligations arising from the contract and positive legal regulations, and the Agency undertakes to protect the same information. The reservation becomes valid when the advance payment or the full amount for the requested excursion or trip is paid. The full amount for the requested excursion or trip must be paid by the agreed date, otherwise the reservation is canceled.

4. PAYMENT

A deposit or the full amount is paid depending on the excursion (unless otherwise stated in the service description), as follows:

• For excursions: the full amount is charged upon confirmation of the reservation.

After visible payment of the full amount, the Agency issues an invoice and voucher, which is also a confirmation of the reservation, which the Traveler is obliged to present to the Agency immediately before departure for the excursion or trip. Payments can be made:

• online (card payment) via the integrated online payment system (Internet banking or general bank payment slip)
• at the Agency’s branch office

Prices for services in the excursion or trip program are expressed in euros (€).

5. SERVICE PRICES

The prices of excursions and trips are published in the content description on the Agency’s website www.etuktoursmakarska.com and are valid from the date of publication. If it is a trip or trip in which the Agency is an authorized sales agent, the prices are based on the cooperation agreement between the Agency and the service provider and/or organizer and do not have to correspond to the prices on site. Any differences in prices cannot be the subject of objections. If there are changes in applicable tax regulations, changes in the exchange rate of the contracted currency, an increase in transportation costs, including fuel costs, or an increase in fees for certain services, which affect the price, the Agency reserves the right to change the price no later than 7 days before the start of the trip and 20 days before the start of the trip. The price increase is calculated in the same percentage as the change in the aforementioned calculation elements. If the price increase exceeds 10 percent of the agreed price, the Traveler has the right to terminate the reservation or contract without any obligation to pay damages. The Traveler is obliged to notify the Agency in writing of the termination of the contract within 2 days of receiving the notification, otherwise it is considered that he/she agrees with the price change. If the price changes have caused a price reduction, the Agency will refund the Traveler the difference up to the previously agreed amount.

6. CATEGORIZATION OF SERVICES

The offered means of transport, accommodation facilities, restaurants and other services are described according to the official categorization of the local tourist organization or other competent body at the time of creating the offer and issuing the program. The standards of food, means of transport, accommodation facilities and other services in individual places and countries are different and are not comparable. The Agency does not assume responsibility for any oral or written information that is not in accordance with the description of the services in the program and the General Terms and Conditions, and which information the Traveler
